  伊春市建(jian)(jian)立完善守信联合激励和失信联合惩戒(jie)制(zhi)度(du)加快推进社会(hui)诚信建(jian)(jian)设实施方案

  为贯彻落(luo)实《国(guo)务院关(guan)于建(jian)立完善守(shou)信联合(he)激(ji)励和(he)失信联合(he)惩(cheng)戒(jie)制度加快推进社会诚信建(jian)设的指导意见(jian)》(国(guo)发〔2016〕33号)和《黑龙江省人民政府关于建立完善守信联合激励和失信联合惩戒制度加快推进社会诚信建设的实施意见》(黑政规〔2017〕5号)精神,结合我市实际,制定本方案。

  一、总(zong)体要求

  (一)指(zhi)导思想。全(quan)面贯(guan)彻(che)(che)党(dang)的十(shi)八(ba)大(da)和(he)十(shi)八(ba)届三中(zhong)、四中(zhong)、五中(zhong)、六(liu)中(zhong)全(quan)会精(jing)神,深入(ru)贯(guan)彻(che)(che)习近平总书记(ji)系列重要讲话(hua)特别(bie)是对(dui)我省两(liang)次(ci)重要讲话(hua)精(jing)神,按照党(dang)中(zhong)央、国务院(yuan)决策部署(shu),紧紧围绕“四个全面”战略布局,牢固树立创新、协调、绿色、开放、共享发展理念,落实加强和创新社会治理要求,加快推进社会信用体系建设,加强信用信息公开和共享,依法依规运用信用激励和约束手段,构建政府、社会共同参与的跨地区、跨部门、跨领域的守信联合激励和失信联合惩戒机制,促进市场主体依法诚信经营,维护市场正常秩序,营造诚信社会环境。

  (二)工作(zuo)目标。到2017年底,基本建立政府部门联合奖惩机制,推动企业、自然人、社团组织、机关事业单位信用信息的查询、公开共享和管理应用服务;建立完善信用分类管理、信用信息归集共享、信用信息公示、信用协同监管,使守信激励和失信惩戒机制在重要领域较好发挥作用。到2020年底,全面建成政府与社会共同参与的联合奖惩机制,形成政府部门协同联动、行业组织自律管理、信用服务机构积极参与、社会舆论广泛监督的共同治理格局。

  二、工作任务

  (一(yi))健全褒扬和激励诚信行为机制

1.探索建立行(xing)政(zheng)审批“绿色通(tong)道”。在(zai)办理(li)(li)行(xing)政(zheng)许可过程中,对诚信典型(xing)和(he)连续三年无不(bu)良信用(yong)记录的(de)行(xing)政(zheng)相(xiang)对人,可根据(ju)实际情况实施“绿色通(tong)道”和(he)“容缺(que)受理(li)(li)”等便(bian)利服务措施。对符合条件的(de)行(xing)政(zheng)相(xiang)对人,除法律法规(gui)要求提供的(de)材料外(wai),部分申(shen)报(bao)材料不(bu)齐备的(de),如其书(shu)面承(cheng)诺在(zai)规(gui)定(ding)期(qi)限(xian)内(nei)提供,应(ying)先行(xing)受理(li)(li),加快办理(li)(li)进度。(责任单(dan)位(wei):中、省、市直有关(guan)单(dan)位(wei),各县〔市〕、区(qu)政(zheng)府)

2.优先(xian)(xian)提供公共(gong)服务(wu)便利。在(zai)实(shi)施财政性资(zi)(zi)(zi)金项目(mu)安排(pai)、招商(shang)引资(zi)(zi)(zi)配套优惠(hui)政策等各类政府优惠(hui)政策中(zhong),优先(xian)(xian)考虑诚信(xin)市(shi)(shi)(shi)(shi)场主(zhu)体,加大扶持力度。在(zai)教育(yu)(yu)、就业(ye)、创业(ye)、医疗卫生(sheng)、社会保障等领域对诚信(xin)个人给予重点支持和优先(xian)(xian)便利。在(zai)有关公共(gong)资(zi)(zi)(zi)源交易活动中(zhong),提倡依法依约对诚信(xin)市(shi)(shi)(shi)(shi)场主(zhu)体采取(qu)信(xin)用加分等措施。(责任(ren)单位:市(shi)(shi)(shi)(shi)发改委(wei)、市(shi)(shi)(shi)(shi)财政局(ju)(ju)(ju)(ju)〔国(guo)资(zi)(zi)(zi)办(ban)〕、市(shi)(shi)(shi)(shi)商(shang)务(wu)局(ju)(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)教育(yu)(yu)局(ju)(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)人社局(ju)(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)卫计委(wei)、市(shi)(shi)(shi)(shi)住(zhu)建局(ju)(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)国(guo)土资(zi)(zi)(zi)源局(ju)(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)交通运输局(ju)(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)水(shui)务(wu)局(ju)(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)水(shui)文局(ju)(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)工商(shang)局(ju)(ju)(ju)(ju),各县(xian)〔市(shi)(shi)(shi)(shi)〕、区政府)

3.优化(hua)诚信(xin)(xin)企业(ye)(ye)行政监(jian)管安排。各级市场监(jian)管部门应(ying)根据监(jian)管对(dui)(dui)象的信(xin)(xin)用记录和信(xin)(xin)用评价分类(lei),注(zhu)重运用大(da)数据手段,完善事中事后监(jian)管措施,为市场主体提供便利化(hua)服务。对(dui)(dui)符合一定条件的诚信(xin)(xin)企业(ye)(ye),在日常检(jian)查(cha)、专(zhuan)项检(jian)查(cha)中优化(hua)检(jian)查(cha)频次。(责任(ren)单(dan)位(wei):中、省、市直有(you)关(guan)单(dan)位(wei),各县(xian)〔市〕、区政府)

4.降低市(shi)(shi)场(chang)交易(yi)成(cheng)本。鼓(gu)励有关部门和(he)(he)(he)单位开(kai)发“税(shui)易(yi)贷”、“信易(yi)贷”、“信易(yi)债”等守(shou)(shou)信激励产品。引导征信机(ji)构加(jia)强对(dui)市(shi)(shi)场(chang)主体正面(mian)信息的采集,对(dui)守(shou)(shou)信者(zhe)(zhe)加(jia)大激励性(xing)评分(fen)比重(zhong)。引导金(jin)(jin)融机(ji)构和(he)(he)(he)商(shang)业销(xiao)售机(ji)构等市(shi)(shi)场(chang)服务机(ji)构参(can)考使(shi)用市(shi)(shi)场(chang)主体信用信息、信用积分(fen)和(he)(he)(he)信用评价(jia)结果,对(dui)诚信市(shi)(shi)场(chang)主体给予优惠(hui)和(he)(he)(he)便利(li),使(shi)守(shou)(shou)信者(zhe)(zhe)在市(shi)(shi)场(chang)中获得更(geng)多机(ji)会和(he)(he)(he)实惠(hui)。(责任单位:市(shi)(shi)金(jin)(jin)融办、市(shi)(shi)地税(shui)局(ju)、市(shi)(shi)国(guo)税(shui)局(ju)、人民银行伊春市(shi)(shi)中心支行、伊春银监分(fen)局(ju),各县〔市(shi)(shi)〕、区政府)

5.大力推(tui)介(jie)诚(cheng)信(xin)(xin)典型(xing)。将(jiang)有(you)关部(bu)门和(he)社会(hui)(hui)(hui)组(zu)织(zhi)(zhi)实(shi)施信(xin)(xin)用(yong)分类监管确(que)定的(de)(de)信(xin)(xin)用(yong)状况良(liang)(liang)好(hao)的(de)(de)行(xing)政(zheng)相对人、诚(cheng)信(xin)(xin)道德模范、优秀青年志(zhi)愿者,行(xing)业协会(hui)(hui)(hui)商(shang)会(hui)(hui)(hui)推(tui)荐的(de)(de)诚(cheng)信(xin)(xin)会(hui)(hui)(hui)员,新闻媒体挖(wa)掘的(de)(de)诚(cheng)信(xin)(xin)主(zhu)体等(deng)树立(li)为诚(cheng)信(xin)(xin)典型(xing)。鼓(gu)励(li)有(you)关部(bu)门和(he)社会(hui)(hui)(hui)组(zu)织(zhi)(zhi)在(zai)监管和(he)服务中(zhong)(zhong)建立(li)各类主(zhu)体信(xin)(xin)用(yong)记录,向(xiang)社会(hui)(hui)(hui)推(tui)介(jie)无不(bu)良(liang)(liang)信(xin)(xin)用(yong)记录者和(he)有(you)关诚(cheng)信(xin)(xin)典型(xing),联合其他部(bu)门和(he)社会(hui)(hui)(hui)组(zu)织(zhi)(zhi)实(shi)施守信(xin)(xin)激励(li)。各级政(zheng)府部(bu)门应将(jiang)诚(cheng)信(xin)(xin)典型(xing)优良(liang)(liang)信(xin)(xin)用(yong)信(xin)(xin)息及时(shi)在(zai)政(zheng)府网站和(he)“信(xin)(xin)用(yong)伊春(chun)”网站进行(xing)公示,在(zai)哈洽会(hui)(hui)(hui)、中(zhong)(zhong)俄博(bo)(bo)览(lan)会(hui)(hui)(hui)、绿色有(you)机食品(pin)博(bo)(bo)览(lan)会(hui)(hui)(hui)、森博(bo)(bo)会(hui)(hui)(hui)等(deng)会(hui)(hui)(hui)展活(huo)动以及银企对接等(deng)活(huo)动中(zhong)(zhong)重(zhong)点(dian)推(tui)介(jie)诚(cheng)信(xin)(xin)企业,让信(xin)(xin)用(yong)成为市(shi)(shi)(shi)(shi)场配置资源(yuan)的(de)(de)重(zhong)要考量因(yin)素。(责任单(dan)位:市(shi)(shi)(shi)(shi)委宣传部(bu)、市(shi)(shi)(shi)(shi)文明办、团市(shi)(shi)(shi)(shi)委、市(shi)(shi)(shi)(shi)工商(shang)局(ju)、市(shi)(shi)(shi)(shi)工信(xin)(xin)委、市(shi)(shi)(shi)(shi)金融办、市(shi)(shi)(shi)(shi)民政(zheng)局(ju)、市(shi)(shi)(shi)(shi)商(shang)务局(ju),各县〔市(shi)(shi)(shi)(shi)〕、区政(zheng)府)

  (二)健全约束和惩(cheng)戒(jie)失信行为(wei)机制

6.对(dui)重(zhong)点(dian)领域和(he)严(yan)(yan)重(zhong)失信(xin)(xin)行(xing)(xing)(xing)为(wei)(wei)实施联合惩戒(jie)。在有关(guan)部(bu)门和(he)社(she)会(hui)组织(zhi)依法(fa)(fa)依规对(dui)本领域失信(xin)(xin)行(xing)(xing)(xing)为(wei)(wei)作(zuo)出(chu)处(chu)理和(he)评价基础上(shang),通过信(xin)(xin)息共享,推(tui)动其他部(bu)门和(he)社(she)会(hui)组织(zhi)依法(fa)(fa)依规对(dui)严(yan)(yan)重(zhong)失信(xin)(xin)行(xing)(xing)(xing)为(wei)(wei)采取联合惩戒(jie)措施。重(zhong)点(dian)包括(kuo):一是(shi)严(yan)(yan)重(zhong)危害人民群众(zhong)(zhong)身体健康和(he)生(sheng)(sheng)(sheng)命安(an)全的(de)行(xing)(xing)(xing)为(wei)(wei),包括(kuo)食品药(yao)品、医疗卫(wei)生(sheng)(sheng)(sheng)、生(sheng)(sheng)(sheng)态环境、工(gong)(gong)程质(zhi)量、安(an)全生(sheng)(sheng)(sheng)产(chan)、消防(fang)安(an)全、强制(zhi)性(xing)产(chan)品认证、特(te)种设(she)备安(an)全、进出(chu)境质(zhi)量安(an)全和(he)卫(wei)生(sheng)(sheng)(sheng)安(an)全等(deng)(deng)领域的(de)严(yan)(yan)重(zhong)失信(xin)(xin)行(xing)(xing)(xing)为(wei)(wei)。二是(shi)严(yan)(yan)重(zhong)破(po)坏市(shi)(shi)场公平竞(jing)争秩序(xu)(xu)和(he)社(she)会(hui)正(zheng)常秩序(xu)(xu)的(de)行(xing)(xing)(xing)为(wei)(wei),包括(kuo)贿赂、逃(tao)税骗税、恶(e)意(yi)逃(tao)废债(zhai)务、恶(e)意(yi)拖(tuo)欠(qian)货(huo)款或(huo)服务费(fei)、未(wei)与(yu)劳(lao)动者订立书面劳(lao)动合同、不参(can)加(jia)社(she)会(hui)保险登记、未(wei)足额缴纳社(she)会(hui)保险费(fei)、恶(e)意(yi)欠(qian)薪、非法(fa)(fa)集资、合同欺(qi)诈、传销、无(wu)证照经营、制(zhi)售假(jia)冒伪劣产(chan)品和(he)故意(yi)侵犯知识产(chan)权(quan)、出(chu)借和(he)借用(yong)资质(zhi)投标(biao)、围标(biao)串标(biao)、以(yi)弄(nong)虚作(zuo)假(jia)或(huo)行(xing)(xing)(xing)贿方式参(can)与(yu)公共资源(yuan)交易、泄漏应当保密的(de)与(yu)公共资源(yuan)交易活动有关(guan)的(de)情况和(he)资料、虚假(jia)广告、侵害消费(fei)者或(huo)证券期货(huo)投资者合法(fa)(fa)权(quan)益、严(yan)(yan)重(zhong)破(po)坏网络空间传播秩序(xu)(xu)、聚众(zhong)(zhong)扰(rao)乱(luan)社(she)会(hui)秩序(xu)(xu)等(deng)(deng)严(yan)(yan)重(zhong)失信(xin)(xin)行(xing)(xing)(xing)为(wei)(wei)。三(san)是(shi)拒(ju)(ju)不履行(xing)(xing)(xing)法(fa)(fa)定义务,严(yan)(yan)重(zhong)影响司(si)(si)法(fa)(fa)机(ji)关(guan)、行(xing)(xing)(xing)政(zheng)机(ji)关(guan)公信(xin)(xin)力的(de)行(xing)(xing)(xing)为(wei)(wei),包括(kuo)当事人在司(si)(si)法(fa)(fa)机(ji)关(guan)、行(xing)(xing)(xing)政(zheng)机(ji)关(guan)作(zuo)出(chu)判决或(huo)决定后,有履行(xing)(xing)(xing)能力但(dan)拒(ju)(ju)不履行(xing)(xing)(xing)、逃(tao)避执行(xing)(xing)(xing)等(deng)(deng)严(yan)(yan)重(zhong)失信(xin)(xin)行(xing)(xing)(xing)为(wei)(wei)。四是(shi)拒(ju)(ju)不履行(xing)(xing)(xing)国防(fang)义务,拒(ju)(ju)绝、逃(tao)避兵役(yi),拒(ju)(ju)绝、拖(tuo)延民用(yong)资源(yuan)征(zheng)用(yong)或(huo)者阻碍(ai)对(dui)被征(zheng)用(yong)的(de)民用(yong)资源(yuan)进行(xing)(xing)(xing)改(gai)造,危害国防(fang)利(li)益,破(po)坏国防(fang)设(she)施等(deng)(deng)行(xing)(xing)(xing)为(wei)(wei)。(责任单位:市(shi)(shi)工(gong)(gong)商(shang)局(ju)(ju)(ju)、市(shi)(shi)发改(gai)委、市(shi)(shi)财(cai)政(zheng)局(ju)(ju)(ju)〔国资办〕、市(shi)(shi)环保局(ju)(ju)(ju)、市(shi)(shi)住(zhu)建(jian)局(ju)(ju)(ju)、市(shi)(shi)交通运输局(ju)(ju)(ju)、市(shi)(shi)公安(an)局(ju)(ju)(ju)、市(shi)(shi)人社(she)局(ju)(ju)(ju)、市(shi)(shi)水(shui)务局(ju)(ju)(ju)、市(shi)(shi)水(shui)文(wen)局(ju)(ju)(ju)、市(shi)(shi)食品药(yao)品监管局(ju)(ju)(ju)、市(shi)(shi)安(an)监局(ju)(ju)(ju)、市(shi)(shi)质(zhi)监局(ju)(ju)(ju)、市(shi)(shi)地税局(ju)(ju)(ju)、市(shi)(shi)国税局(ju)(ju)(ju)、市(shi)(shi)科技(ji)局(ju)(ju)(ju)、市(shi)(shi)人防(fang)办、人民银行(xing)(xing)(xing)伊(yi)春市(shi)(shi)中心支行(xing)(xing)(xing)、伊(yi)春出(chu)入境检验检疫局(ju)(ju)(ju)、市(shi)(shi)法(fa)(fa)院,各县〔市(shi)(shi)〕、区政(zheng)府)

7.依法(fa)(fa)(fa)(fa)(fa)依规加强对(dui)(dui)失(shi)信(xin)(xin)行(xing)(xing)为(wei)的(de)行(xing)(xing)政性约束和(he)惩(cheng)戒。对(dui)(dui)被列(lie)(lie)入经(jing)营(ying)异(yi)常(chang)名录(lu)、严(yan)重(zhong)(zhong)(zhong)违法(fa)(fa)(fa)(fa)(fa)失(shi)信(xin)(xin)企(qi)(qi)业、失(shi)信(xin)(xin)被执行(xing)(xing)人(ren)(ren)、重(zhong)(zhong)(zhong)大税(shui)收(shou)违法(fa)(fa)(fa)(fa)(fa)案件当事(shi)人(ren)(ren)、违法(fa)(fa)(fa)(fa)(fa)上市(shi)(shi)(shi)(shi)公(gong)司相(xiang)关责(ze)任(ren)主(zhu)(zhu)体、安全生(sheng)产领域失(shi)信(xin)(xin)生(sheng)产经(jing)营(ying)单(dan)位(wei)及(ji)(ji)其(qi)有(you)(you)关人(ren)(ren)员(yuan)等严(yan)重(zhong)(zhong)(zhong)失(shi)信(xin)(xin)主(zhu)(zhu)体,各(ge)地、各(ge)有(you)(you)关部门应(ying)将其(qi)列(lie)(lie)为(wei)重(zhong)(zhong)(zhong)点监管对(dui)(dui)象(xiang),依法(fa)(fa)(fa)(fa)(fa)依规采取行(xing)(xing)政性约束和(he)惩(cheng)戒措施(shi)(shi)(shi)。从严(yan)审核(he)(he)行(xing)(xing)政许(xu)可(ke)审批(pi)项目(mu),从严(yan)控制(zhi)生(sheng)产许(xu)可(ke)证发(fa)放,限(xian)制(zhi)新(xin)增项目(mu)审批(pi)、核(he)(he)准,限(xian)制(zhi)股票发(fa)行(xing)(xing)上市(shi)(shi)(shi)(shi)融资(zi)或发(fa)行(xing)(xing)债券(quan),限(xian)制(zhi)发(fa)起设(she)立或参(can)(can)股金(jin)融机(ji)构以及(ji)(ji)小(xiao)额贷款公(gong)司、融资(zi)担保(bao)公(gong)司、创业投(tou)资(zi)公(gong)司、互联网融资(zi)平台(tai)等机(ji)构,限(xian)制(zhi)从事(shi)互联网信(xin)(xin)息(xi)服务等。严(yan)格限(xian)制(zhi)申(shen)请财(cai)(cai)政性资(zi)金(jin)项目(mu),限(xian)制(zhi)参(can)(can)与(yu)有(you)(you)关公(gong)共资(zi)源交易活动,限(xian)制(zhi)参(can)(can)与(yu)基础设(she)施(shi)(shi)(shi)和(he)公(gong)用事(shi)业特许(xu)经(jing)营(ying)。对(dui)(dui)事(shi)权在国(guo)家和(he)省(sheng)相(xiang)关部门的(de)惩(cheng)戒事(shi)项,在向国(guo)家和(he)省(sheng)申(shen)报时,注明失(shi)信(xin)(xin)情(qing)况,建(jian)议国(guo)家和(he)省(sheng)审慎对(dui)(dui)待。对(dui)(dui)严(yan)重(zhong)(zhong)(zhong)失(shi)信(xin)(xin)企(qi)(qi)业及(ji)(ji)其(qi)法(fa)(fa)(fa)(fa)(fa)定(ding)(ding)代(dai)表人(ren)(ren)、主(zhu)(zhu)要负责(ze)人(ren)(ren)和(he)对(dui)(dui)失(shi)信(xin)(xin)行(xing)(xing)为(wei)负有(you)(you)直(zhi)接(jie)责(ze)任(ren)的(de)注册执业人(ren)(ren)员(yuan)等实施(shi)(shi)(shi)市(shi)(shi)(shi)(shi)场和(he)行(xing)(xing)业禁入措施(shi)(shi)(shi)。被列(lie)(lie)入严(yan)重(zhong)(zhong)(zhong)违法(fa)(fa)(fa)(fa)(fa)失(shi)信(xin)(xin)企(qi)(qi)业名单(dan)的(de)企(qi)(qi)业的(de)法(fa)(fa)(fa)(fa)(fa)定(ding)(ding)代(dai)表人(ren)(ren)、负责(ze)人(ren)(ren),3年内不得担任(ren)其(qi)他企(qi)(qi)业的(de)法(fa)(fa)(fa)(fa)(fa)定(ding)(ding)代(dai)表人(ren)(ren)、负责(ze)人(ren)(ren)。及(ji)(ji)时撤销严(yan)重(zhong)(zhong)(zhong)失(shi)信(xin)(xin)企(qi)(qi)业及(ji)(ji)其(qi)法(fa)(fa)(fa)(fa)(fa)定(ding)(ding)代(dai)表人(ren)(ren)、负责(ze)人(ren)(ren)、高级管理人(ren)(ren)员(yuan)和(he)对(dui)(dui)失(shi)信(xin)(xin)行(xing)(xing)为(wei)负有(you)(you)直(zhi)接(jie)责(ze)任(ren)的(de)董(dong)事(shi)、股东等人(ren)(ren)员(yuan)的(de)荣誉称号,取消参(can)(can)加评(ping)(ping)先评(ping)(ping)优资(zi)格。(责(ze)任(ren)单(dan)位(wei):市(shi)(shi)(shi)(shi)工商局(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)法(fa)(fa)(fa)(fa)(fa)院、市(shi)(shi)(shi)(shi)地税(shui)局(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)国(guo)税(shui)局(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)安监局(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)发(fa)改(gai)委(wei)、市(shi)(shi)(shi)(shi)工信(xin)(xin)委(wei)、市(shi)(shi)(shi)(shi)金(jin)融办、市(shi)(shi)(shi)(shi)财(cai)(cai)政局(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)质监局(ju)(ju)(ju),各(ge)县〔市(shi)(shi)(shi)(shi)〕、区政府)

16.建(jian)立(li)健全(quan)信(xin)(xin)(xin)(xin)用主体(ti)(ti)权益(yi)保护机制。建(jian)立(li)健全(quan)信(xin)(xin)(xin)(xin)用信(xin)(xin)(xin)(xin)息异议、投(tou)诉(su)制度。有(you)(you)关部门和(he)单(dan)位在(zai)执(zhi)(zhi)行(xing)失(shi)信(xin)(xin)(xin)(xin)联(lian)(lian)合(he)惩戒措施时主动发现、经市场主体(ti)(ti)提出(chu)异议申请或投(tou)诉(su)发现信(xin)(xin)(xin)(xin)息不实(shi)的(de),应(ying)(ying)及时告(gao)知信(xin)(xin)(xin)(xin)息提供单(dan)位核(he)(he)实(shi),信(xin)(xin)(xin)(xin)息提供单(dan)位应(ying)(ying)尽(jin)快核(he)(he)实(shi)并(bing)反馈(kui)。联(lian)(lian)合(he)惩戒措施在(zai)信(xin)(xin)(xin)(xin)息核(he)(he)实(shi)期(qi)间暂不执(zhi)(zhi)行(xing)。经核(he)(he)实(shi)有(you)(you)误的(de)信(xin)(xin)(xin)(xin)息应(ying)(ying)及时更正或撤销。因错误采取联(lian)(lian)合(he)惩戒措施损害有(you)(you)关主体(ti)(ti)合(he)法权益(yi)的(de),有(you)(you)关部门和(he)单(dan)位应(ying)(ying)积极(ji)采取措施恢复其信(xin)(xin)(xin)(xin)誉(yu)、消除(chu)不良影响。支持(chi)有(you)(you)关主体(ti)(ti)通(tong)过行(xing)政复议、行(xing)政诉(su)讼等方式维护自(zi)身合(he)法权益(yi)。(责任单(dan)位:中、省、市直有(you)(you)关单(dan)位)

  三、保障(zhang)措施(shi)

  (一)加强(qiang)组织实(shi)施(shi)。各(ge)(ge)(ge)地、各(ge)(ge)(ge)有(you)关部(bu)门(men)要(yao)把实(shi)施(shi)守信(xin)(xin)联合(he)激(ji)(ji)(ji)励(li)(li)和(he)失信(xin)(xin)联合(he)惩戒(jie)作为推进社会(hui)信(xin)(xin)用体(ti)系建(jian)(jian)设的(de)重要(yao)举措(cuo),认真(zhen)贯彻(che)落实(shi)本方(fang)案并制定(ding)具体(ti)措(cuo)施(shi),切实(shi)加强(qiang)组织领导,建(jian)(jian)立完善(shan)信(xin)(xin)用联合(he)激(ji)(ji)(ji)励(li)(li)惩戒(jie)工作的(de)各(ge)(ge)(ge)项(xiang)制度,落实(shi)工作机构、人员编(bian)制、项(xiang)目经费等(deng)必要(yao)保障,确保各(ge)(ge)(ge)项(xiang)联合(he)激(ji)(ji)(ji)励(li)(li)和(he)联合(he)惩戒(jie)措(cuo)施(shi)落实(shi)到位。建(jian)(jian)立守信(xin)(xin)联合(he)激(ji)(ji)(ji)励(li)(li)和(he)失信(xin)(xin)联合(he)惩戒(jie)的(de)发起与响应机制,各(ge)(ge)(ge)领域(yu)守信(xin)(xin)联合(he)激(ji)(ji)(ji)励(li)(li)和(he)失信(xin)(xin)联合(he)惩戒(jie)的(de)发起部(bu)门(men)负责确定(ding)激(ji)(ji)(ji)励(li)(li)和(he)惩戒(jie)对象(xiang),实(shi)施(shi)部(bu)门(men)负责对有(you)关主(zhu)体(ti)采取相应的(de)联合(he)激(ji)(ji)(ji)励(li)(li)和(he)联合(he)惩戒(jie)措(cuo)施(shi)。鼓励(li)(li)有(you)关地区(qu)(qu)和(he)部(bu)门(men)先(xian)行先(xian)试,通(tong)过签署(shu)合(he)作备忘录(lu)或(huo)出台(tai)规(gui)范(fan)性文(wen)件(jian)等(deng)多种方(fang)式建(jian)(jian)立长效机制,不断丰富信(xin)(xin)用激(ji)(ji)(ji)励(li)(li)内(nei)容,强(qiang)化信(xin)(xin)用约束(shu)措(cuo)施(shi)。(责任单(dan)位:中(zhong)、省、市直(zhi)有(you)关单(dan)位,各(ge)(ge)(ge)县〔市〕、区(qu)(qu)政府)

  (二(er))加强(qiang)跟踪问效。充分利用省信用信息共享(xiang)交换平台和“信用伊春”网站,建立健全信用联合激励惩戒的跟踪、监测、统计、评估机制并建立相应的督查、考核制度,将考核结果纳入对各地、各部门年度责任目标考核。对信用信息归集、共享和激励惩戒措施落实不力的部门和单位,进行通报和督促整改,切实把各项联合激励和联合惩戒措施落到实处。市工商局要加强统筹协调,及时跟踪掌握工作进展,督促检查任务落实情况并报告市政府。市政府将对本方案的贯彻落实情况适时开展专项督查。(责任单位:市政府办、市工商局,各县〔市〕、区政府)
