黑龙江省方正县人民政府关于建立完善守信联合激励和失信联合惩戒制度加快推进信用方正建设的实施意见

  为贯彻落实《国务(wu)院关于(yu)深入推进(jin)实施新一轮(lun)东北(bei)振兴战(zhan)略加(jia)快推动东北(bei)地区经济企稳(wen)向(xiang)好(hao)若干重要举措(cuo)的意见(jian)》(国发〔2016〕62号)、《国务院关于建立完善守信联合激励和失信联合惩戒制度加快推进社会诚信建设的指导意见》(国发〔2016〕33号)、《黑龙江省人民政府关于建立完善守信联合激励和失信联合惩戒制度加快推进社会诚信建设的实施意见》(黑政规〔2017〕5号)和《哈尔滨市人民政府关于建立完善守信联合激励和失信联合惩戒制度推动信用东北建设实施意见》(哈政规〔2017〕24号)精神,积极构建以信用为核心的行政管理、市场监管和社会治理体系,加快推进“信用方正”建设,现结合我县实际,提出如下意见。

  一、总体要求

(一)指导(dao)思想

  全面贯彻党的(de)十九(jiu)大和习(xi)近(jin)平(ping)总书记系列(lie)重要讲话精(jing)神,按(an)照国家省和市(shi)的(de)决策部署,紧紧围绕“四个全面”战略布局和“五大”发展理念,落实加强和创新社会治理要求,加快推进全县社会信用体系建设。加强信用信息归集共享、公开应用,依法依规运用信用激励和约束手段,构建政府、社会共同参与的跨地区、跨部门、跨领域的守信联合激励和失信联合惩戒机制,促进市场主体依法诚信经营,维护市场正常秩序,营造良好信用环境。

(二(er))基本原(yuan)则

1.坚持信(xin)(xin)用(yong)公开。在做好信(xin)(xin)用(yong)信(xin)(xin)息记(ji)录归集工作的基础上(shang),逐步将(jiang)社会法(fa)人(ren)、自然人(ren)和(he)社会组(zu)织等(deng)各类社会信(xin)(xin)用(yong)主(zhu)体的信(xin)(xin)用(yong)信(xin)(xin)息统一归集并公开。

2.坚持奖惩分(fen)(fen)明(ming)。充(chong)分(fen)(fen)运用(yong)信(xin)用(yong)激励和约束手段,建(jian)立健全守信(xin)者(zhe)受(shou)益、失(shi)信(xin)者(zhe)受(shou)限的奖惩机制。

3.坚持突出重点(dian)。着力解决涉及公共(gong)利益和(he)安全、人民群(qun)众反映强(qiang)烈、对社会发展负面影响(xiang)较(jiao)大的(de)重点(dian)领域(yu)失信问题。

4.坚(jian)持协(xie)同联动(dong)。构建政府(fu)部门协(xie)同联动(dong)、行业组织(zhi)自律管(guan)理、信用服务(wu)机(ji)构积极参与、社会舆论广(guang)泛监督的(de)共(gong)同治理格局。

(三)工作目标

  进(jin)一(yi)步(bu)加大(da)失信违(wei)约惩戒力(li)度,突出抓好(hao)政府(fu)违(wei)约专项整治,大(da)力(li)倡(chang)导做诚(cheng)信之人、办诚(cheng)信之企、建(jian)诚(cheng)信政府(fu)。到2018年4月底,基本建立经济社会主要领域守信联合激励和失信联合惩戒机制。到2020年,初步形成政府部门协同联动、行业组织自律管理、信用服务机构积极参与、社会舆论广泛参与的共同治理工作格局,基本建立跨地区、跨部门、跨领域的守信联合激励和失信联合惩戒工作机制,以信用为核心的新型市场监管机制作用得到有效发挥,全社会信用意识普遍增强,“信用方正”建设取得积极效果。

  二、重点工作任务

(一)建立(li)完善守信联合激励机制

1.多渠道(dao)选树(shu)诚(cheng)信(xin)(xin)典型(xing)。2018年4月底前,各部(bu)门和(he)社(she)会组(zu)织(zhi)建立(li)并完(wan)善社(she)会法人、自然人和(he)社(she)会组(zu)织(zhi)信(xin)(xin)用(yong)(yong)评价机制,及时、全(quan)面、准确记录信(xin)(xin)用(yong)(yong)主体的信(xin)(xin)用(yong)(yong)信(xin)(xin)息;建立(li)常态(tai)化(hua)报送工作机制,依(yi)托市信(xin)(xin)用(yong)(yong)信(xin)(xin)息共享平台(tai)共享信(xin)(xin)息,联合相关部(bu)门和(he)社(she)会组(zu)织(zhi)实施守信(xin)(xin)激励。开(kai)展诚(cheng)信(xin)(xin)创建活(huo)动,依(yi)法依(yi)规将信(xin)(xin)用(yong)(yong)状况良好的行政相对人、“诚(cheng)信(xin)(xin)示范单位”、“守合同(tong)重(zhong)信(xin)(xin)用(yong)(yong)”企业(ye)、“诚(cheng)信(xin)(xin)经营(ying)示范点”、诚(cheng)信(xin)(xin)道(dao)德模(mo)范、优秀青年志愿者、行业(ye)协会商会推荐的诚(cheng)信(xin)(xin)会员、新闻(wen)媒(mei)体挖(wa)掘的诚(cheng)信(xin)(xin)主体等树(shu)立(li)为诚(cheng)实守信(xin)(xin)典型(xing)。(县市场监管局、县文明(ming)办、县民政局分(fen)(fen)别(bie)牵(qian)头,各部(bu)门按(an)职责分(fen)(fen)工负(fu)责)

2.完善行(xing)(xing)(xing)政(zheng)(zheng)(zheng)审批(pi)(pi)绿(lv)色(se)通(tong)道(dao)。2018年3月底前,各部门(men)行(xing)(xing)(xing)政(zheng)(zheng)(zheng)审批(pi)(pi)机构依据(ju)权力清单和责任(ren)清单,针对诚(cheng)信(xin)典(dian)型和连续3年无不(bu)良信(xin)用记录的行(xing)(xing)(xing)政(zheng)(zheng)(zheng)相对人(ren),制定(ding)实施(shi)“绿(lv)色(se)通(tong)道(dao)”、“容缺受(shou)理”等(deng)(deng)行(xing)(xing)(xing)政(zheng)(zheng)(zheng)审批(pi)(pi)便(bian)利服(fu)务(wu)措施(shi)。对符合开辟绿(lv)色(se)通(tong)道(dao)的行(xing)(xing)(xing)政(zheng)(zheng)(zheng)相对人(ren),通(tong)过召(zhao)开协调会、提前介入(ru)等(deng)(deng)方式先(xian)行(xing)(xing)(xing)受(shou)理,加快办理速度。(县行(xing)(xing)(xing)政(zheng)(zheng)(zheng)审批(pi)(pi)服(fu)务(wu)中(zhong)心牵(qian)头,各部门(men)按职责分工(gong)负责)

3.优先(xian)提(ti)供(gong)便利化公共(gong)服务。通过查询省(sheng)、市(shi)信用信息(xi)共(gong)享平台信用信息(xi)或(huo)使用第(di)三方信用服务机(ji)构提(ti)供(gong)的(de)信用报(bao)告等方式,在实施财政(zheng)(zheng)性资金项(xiang)目安排、招(zhao)商引(yin)资配(pei)套优惠(hui)政(zheng)(zheng)策等各类政(zheng)(zheng)府(fu)优惠(hui)政(zheng)(zheng)策中,优先(xian)考虑守(shou)信市(shi)场主(zhu)体。对守(shou)信主(zhu)体给予重(zhong)点支持(chi)和优先(xian)便利。(县(xian)发改局(ju)(ju)、县(xian)财政(zheng)(zheng)局(ju)(ju)、县(xian)国税局(ju)(ju)、县(xian)地税局(ju)(ju)、县(xian)市(shi)场监管(guan)局(ju)(ju)分(fen)别牵头,各部门按职责(ze)分(fen)工负责(ze))

4.创(chuang)新守(shou)信(xin)企(qi)业(ye)行(xing)政监(jian)管(guan)(guan)。县(xian)市(shi)场(chang)(chang)监(jian)管(guan)(guan)部(bu)门(men)在(zai)企(qi)业(ye)监(jian)管(guan)(guan)、食品(pin)药品(pin)安(an)全、消费(fei)安(an)全、安(an)全生产等领域(yu),根(gen)据监(jian)管(guan)(guan)对象的信(xin)用记录和信(xin)用评价分类,运用信(xin)息化手段(duan),创(chuang)新市(shi)场(chang)(chang)经营交易行(xing)为(wei)监(jian)管(guan)(guan)方式,为(wei)市(shi)场(chang)(chang)主体提供便(bian)利服(fu)务。依据国家和省、市(shi)明确的守(shou)信(xin)激(ji)励手段(duan),制定本部(bu)门(men)事中(zhong)、事后(hou)监(jian)管(guan)(guan)实施方案(an),对符合一定条件的守(shou)信(xin)企(qi)业(ye),优化日(ri)常检查和专项(xiang)检查频次。(县(xian)市(shi)场(chang)(chang)监(jian)管(guan)(guan)局、县(xian)安(an)监(jian)局、县(xian)商务粮食局分别(bie)牵头,各部(bu)门(men)按(an)职责分工(gong)负(fu)责)

5.提供(gong)市(shi)场(chang)优(you)惠(hui)服(fu)务。鼓励(li)有关部门(men)和(he)(he)金融机(ji)(ji)构、商业销售机(ji)(ji)构等市(shi)场(chang)服(fu)务机(ji)(ji)构大力开发“信(xin)易贷”、“信(xin)易债”、“税易贷”等守(shou)信(xin)激(ji)励(li)产品,规范提供(gong)市(shi)场(chang)主体(ti)信(xin)用(yong)(yong)信(xin)息、信(xin)用(yong)(yong)积分(fen)和(he)(he)信(xin)用(yong)(yong)评价(jia)结果,对守(shou)信(xin)市(shi)场(chang)主体(ti)给(ji)予优(you)惠(hui)和(he)(he)便利(li),使守(shou)信(xin)者获得更多机(ji)(ji)会和(he)(he)实惠(hui)。(县(xian)人民银行、县(xian)银监局(ju)、县(xian)国(guo)税局(ju)、县(xian)地(di)税局(ju)分(fen)别牵头,各部门(men)按职责(ze)分(fen)工(gong)负责(ze))

6.多渠道推介守(shou)信(xin)(xin)市(shi)(shi)场(chang)(chang)主(zhu)(zhu)体。各(ge)部(bu)(bu)门应及时将(jiang)守(shou)信(xin)(xin)市(shi)(shi)场(chang)(chang)主(zhu)(zhu)体优良信(xin)(xin)用信(xin)(xin)息(xi)报(bao)送至县(xian)(xian)信(xin)(xin)用办(ban),由县(xian)(xian)信(xin)(xin)用办(ban)向上级(ji)主(zhu)(zhu)管(guan)(guan)部(bu)(bu)门报(bao)送在“信(xin)(xin)用哈尔滨”网站进行(xing)(xing)(xing)公示,并在会(hui)展(zhan)、银企(qi)(qi)对(dui)接等活动中(zhong)(zhong)重点推介守(shou)信(xin)(xin)企(qi)(qi)业(ye)(ye),让诚信(xin)(xin)成为市(shi)(shi)场(chang)(chang)配(pei)置资源的(de)重要考(kao)量(liang)(liang)因素。大力宣传(chuan)守(shou)信(xin)(xin)企(qi)(qi)业(ye)(ye)、群体和个人(ren),积极评(ping)选诚实守(shou)信(xin)(xin)道德(de)模范(fan)。支持征信(xin)(xin)机构加强对(dui)市(shi)(shi)场(chang)(chang)主(zhu)(zhu)体正面信(xin)(xin)息(xi)的(de)采集,在失信(xin)(xin)问题反(fan)映较为集中(zhong)(zhong)的(de)行(xing)(xing)(xing)业(ye)(ye)领域,加大对(dui)守(shou)信(xin)(xin)者的(de)激励(li)性评(ping)分(fen)比重。推动行(xing)(xing)(xing)业(ye)(ye)协(xie)会(hui)商(shang)会(hui)加强信(xin)(xin)用建设和行(xing)(xing)(xing)业(ye)(ye)自(zi)(zi)律,表彰守(shou)信(xin)(xin)会(hui)员(yuan)。引导企(qi)(qi)业(ye)(ye)主(zhu)(zhu)动发布综合信(xin)(xin)用承(cheng)诺(nuo)或产(chan)品服务质(zhi)量(liang)(liang)等专项(xiang)承(cheng)诺(nuo),开(kai)展(zhan)产(chan)品服务标(biao)准等自(zi)(zi)我(wo)声明公开(kai),主(zhu)(zhu)动接受社(she)会(hui)监(jian)督。(县(xian)(xian)委宣传(chuan)部(bu)(bu)、县(xian)(xian)文明办(ban)、县(xian)(xian)住建局、县(xian)(xian)国土资源局、县(xian)(xian)市(shi)(shi)场(chang)(chang)监(jian)管(guan)(guan)局、县(xian)(xian)旅(lv)游局、县(xian)(xian)民政局分(fen)别牵(qian)头,各(ge)部(bu)(bu)门按职责(ze)分(fen)工负责(ze))

(二(er))健全完善失信联(lian)合惩戒机制

7.对(dui)重(zhong)(zhong)点领域(yu)严(yan)重(zhong)(zhong)失(shi)信(xin)(xin)行(xing)(xing)(xing)(xing)(xing)(xing)为(wei)实施联合(he)惩戒。2018年3月(yue)底前(qian),各(ge)部门和(he)社(she)会(hui)组(zu)织要制(zhi)定(ding)本(ben)领域(yu)失(shi)信(xin)(xin)行(xing)(xing)(xing)(xing)(xing)(xing)为(wei)认(ren)定(ding)、等(deng)级划分和(he)分类监管实施措(cuo)施,对(dui)失(shi)信(xin)(xin)行(xing)(xing)(xing)(xing)(xing)(xing)为(wei)进(jin)行(xing)(xing)(xing)(xing)(xing)(xing)处(chu)理和(he)评价,并通(tong)过市信(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)息(xi)(xi)共(gong)享平(ping)台实现信(xin)(xin)息(xi)(xi)共(gong)享,推动其他部门和(he)社(she)会(hui)组(zu)织依法依规对(dui)重(zhong)(zhong)点领域(yu)严(yan)重(zhong)(zhong)失(shi)信(xin)(xin)行(xing)(xing)(xing)(xing)(xing)(xing)为(wei)采取联合(he)惩戒措(cuo)施。一是(shi)(shi)(shi)严(yan)重(zhong)(zhong)危害(hai)人民(min)群众身体健(jian)康和(he)生命安全(quan)的行(xing)(xing)(xing)(xing)(xing)(xing)为(wei),包括(kuo)食品药品、生态(tai)环境、工程质(zhi)量、安全(quan)生产、消(xiao)防(fang)安全(quan)、强制(zhi)性产品认(ren)证等(deng)领域(yu)的严(yan)重(zhong)(zhong)失(shi)信(xin)(xin)行(xing)(xing)(xing)(xing)(xing)(xing)为(wei)。二是(shi)(shi)(shi)严(yan)重(zhong)(zhong)破(po)坏市场秩序(xu)和(he)社(she)会(hui)正(zheng)常秩序(xu)的行(xing)(xing)(xing)(xing)(xing)(xing)为(wei),包括(kuo)贿赂、逃(tao)税(shui)骗税(shui)、套取骗取住(zhu)房公积金、故(gu)意(yi)拖(tuo)(tuo)欠或(huo)(huo)少缴以及违规使(shi)用(yong)(yong)(yong)各(ge)类资(zi)金(基金)、恶意(yi)逃(tao)废债务、恶意(yi)拖(tuo)(tuo)欠货款或(huo)(huo)服务费、恶意(yi)欠薪、非法集资(zi)、不正(zheng)当竞争、合(he)同欺(qi)诈、传销、无证照经营、制(zhi)售假冒伪劣产品和(he)故(gu)意(yi)侵(qin)犯知识(shi)产权(quan)、出借和(he)借用(yong)(yong)(yong)资(zi)质(zhi)投标、虚假投标、围标串标、虚假广告、侵(qin)害(hai)消(xiao)费者或(huo)(huo)证券期货投资(zi)者合(he)法权(quan)益(yi)、严(yan)重(zhong)(zhong)破(po)坏网络(luo)空间传播秩序(xu)、聚众扰(rao)乱(luan)社(she)会(hui)秩序(xu)等(deng)严(yan)重(zhong)(zhong)失(shi)信(xin)(xin)行(xing)(xing)(xing)(xing)(xing)(xing)为(wei)。三是(shi)(shi)(shi)拒不履(lv)行(xing)(xing)(xing)(xing)(xing)(xing)法定(ding)义(yi)务,严(yan)重(zhong)(zhong)影响司法机(ji)关(guan)、行(xing)(xing)(xing)(xing)(xing)(xing)政(zheng)机(ji)关(guan)公信(xin)(xin)力的行(xing)(xing)(xing)(xing)(xing)(xing)为(wei),包括(kuo)当事人在(zai)司法机(ji)关(guan)、行(xing)(xing)(xing)(xing)(xing)(xing)政(zheng)机(ji)关(guan)作出判决或(huo)(huo)决定(ding)后,有履(lv)行(xing)(xing)(xing)(xing)(xing)(xing)能力但(dan)拒不履(lv)行(xing)(xing)(xing)(xing)(xing)(xing)、逃(tao)避(bi)(bi)执行(xing)(xing)(xing)(xing)(xing)(xing)等(deng)严(yan)重(zhong)(zhong)失(shi)信(xin)(xin)行(xing)(xing)(xing)(xing)(xing)(xing)为(wei)。四是(shi)(shi)(shi)拒不履(lv)行(xing)(xing)(xing)(xing)(xing)(xing)国防(fang)义(yi)务,拒绝、逃(tao)避(bi)(bi)兵役(yi),拒绝、拖(tuo)(tuo)延(yan)民(min)用(yong)(yong)(yong)资(zi)源征用(yong)(yong)(yong)或(huo)(huo)者阻碍对(dui)被征用(yong)(yong)(yong)的民(min)用(yong)(yong)(yong)资(zi)源进(jin)行(xing)(xing)(xing)(xing)(xing)(xing)改造,危害(hai)国防(fang)利益(yi),破(po)坏国防(fang)设施等(deng)行(xing)(xing)(xing)(xing)(xing)(xing)为(wei)。(各(ge)部门按职责分工负责)

8.对(dui)失(shi)(shi)信(xin)(xin)(xin)行(xing)为实施(shi)行(xing)政(zheng)(zheng)性(xing)(xing)约(yue)束(shu)(shu)和(he)惩戒(jie)。各(ge)部(bu)(bu)门(men)将严(yan)(yan)重(zhong)(zhong)失(shi)(shi)信(xin)(xin)(xin)主(zhu)体(ti)列(lie)为重(zhong)(zhong)点监(jian)管(guan)(guan)对(dui)象,并根据监(jian)管(guan)(guan)职(zhi)权和(he)国家、省、市(shi)有关部(bu)(bu)署(shu),于2018年3月底前制(zhi)(zhi)定、发布针(zhen)对(dui)严(yan)(yan)重(zhong)(zhong)失(shi)(shi)信(xin)(xin)(xin)主(zhu)体(ti)的行(xing)政(zheng)(zheng)性(xing)(xing)约(yue)束(shu)(shu)和(he)惩戒(jie)具(ju)体(ti)措施(shi),明确实施(shi)主(zhu)体(ti)、工作流(liu)程等(deng),依法依规实施(shi)惩戒(jie)。从严(yan)(yan)审核行(xing)政(zheng)(zheng)许可(ke)审批项(xiang)目(mu),从严(yan)(yan)控制(zhi)(zhi)生(sheng)产许可(ke)证发放,限(xian)制(zhi)(zhi)新增项(xiang)目(mu)审批、核准,限(xian)制(zhi)(zhi)发起设立或参(can)股金(jin)融(rong)机构以及(ji)(ji)小额贷款公(gong)(gong)司、融(rong)资(zi)(zi)(zi)担(dan)保公(gong)(gong)司、创业(ye)投资(zi)(zi)(zi)企业(ye)、互联网融(rong)资(zi)(zi)(zi)平台(tai)等(deng)机构,限(xian)制(zhi)(zhi)从事互联网信(xin)(xin)(xin)息(xi)服务(wu)等(deng)。严(yan)(yan)格(ge)(ge)限(xian)制(zhi)(zhi)申(shen)请财政(zheng)(zheng)性(xing)(xing)资(zi)(zi)(zi)金(jin)项(xiang)目(mu),限(xian)制(zhi)(zhi)参(can)与有关公(gong)(gong)共资(zi)(zi)(zi)源交易活动(dong),限(xian)制(zhi)(zhi)参(can)与基(ji)础设施(shi)和(he)公(gong)(gong)用事业(ye)特许经营(ying)。对(dui)严(yan)(yan)重(zhong)(zhong)失(shi)(shi)信(xin)(xin)(xin)企业(ye)及(ji)(ji)其(qi)法定代表人(ren)(ren)(ren)、主(zhu)要负责(ze)人(ren)(ren)(ren)和(he)对(dui)失(shi)(shi)信(xin)(xin)(xin)行(xing)为负有直(zhi)接责(ze)任的注册(ce)执业(ye)人(ren)(ren)(ren)员(yuan)等(deng),实施(shi)市(shi)场(chang)和(he)行(xing)业(ye)禁入措施(shi)。及(ji)(ji)时(shi)撤销(xiao)严(yan)(yan)重(zhong)(zhong)失(shi)(shi)信(xin)(xin)(xin)企业(ye)及(ji)(ji)其(qi)法定代表人(ren)(ren)(ren)、负责(ze)人(ren)(ren)(ren)、高级管(guan)(guan)理人(ren)(ren)(ren)员(yuan)和(he)对(dui)失(shi)(shi)信(xin)(xin)(xin)行(xing)为负有直(zhi)接责(ze)任的董事、股东等(deng)人(ren)(ren)(ren)员(yuan)的荣誉称(cheng)号,并取(qu)消其(qi)参(can)加评(ping)先评(ping)优资(zi)(zi)(zi)格(ge)(ge)。(县(xian)发改局、县(xian)财政(zheng)(zheng)局、县(xian)工信(xin)(xin)(xin)局、县(xian)市(shi)场(chang)监(jian)管(guan)(guan)局、县(xian)住建局、县(xian)商务(wu)粮食(shi)局、县(xian)交通运输(shu)局分别牵头,各(ge)部(bu)(bu)门(men)按职(zhi)责(ze)分工负责(ze))

10.对失信(xin)(xin)行(xing)为(wei)实(shi)施行(xing)业(ye)(ye)性(xing)约束和(he)惩戒。督促(cu)各(ge)级行(xing)业(ye)(ye)协会(hui)(hui)商(shang)会(hui)(hui)加(jia)强诚信(xin)(xin)自(zi)律建设(she),指导行(xing)业(ye)(ye)协会(hui)(hui)商(shang)会(hui)(hui)健全行(xing)业(ye)(ye)自(zi)律公约和(he)职(zhi)业(ye)(ye)道德准(zhun)则(ze),推动行(xing)业(ye)(ye)信(xin)(xin)用(yong)建设(she)。引导行(xing)业(ye)(ye)协会(hui)(hui)商(shang)会(hui)(hui)依法、及(ji)时、准(zhun)确记录会(hui)(hui)员(yuan)严重失信(xin)(xin)行(xing)为(wei),并将相关信(xin)(xin)息纳入会(hui)(hui)员(yuan)信(xin)(xin)用(yong)档(dang)案(an),依托行(xing)业(ye)(ye)主管(guan)部门(men)(men)信(xin)(xin)息系统、市信(xin)(xin)用(yong)信(xin)(xin)息共(gong)享平台等(deng)实(shi)现共(gong)享。鼓励行(xing)业(ye)(ye)协会(hui)(hui)商(shang)会(hui)(hui)与有(you)资质的(de)第三(san)方信(xin)(xin)用(yong)服务机构合作(zuo),遵(zun)循自(zi)愿参加(jia)原则(ze),依法依规开展会(hui)(hui)员(yuan)企业(ye)(ye)信(xin)(xin)用(yong)等(deng)级评(ping)(ping)价(jia)。支持行(xing)业(ye)(ye)协会(hui)(hui)商(shang)会(hui)(hui)按(an)照行(xing)业(ye)(ye)标准(zhun)、行(xing)规、行(xing)约等(deng),视(shi)情(qing)节轻重对失信(xin)(xin)会(hui)(hui)员(yuan)实(shi)行(xing)警告(gao)、行(xing)业(ye)(ye)内通报批评(ping)(ping)、公开谴责、不(bu)予接纳、劝退等(deng)惩戒措施。(县民(min)政局牵头,各(ge)部门(men)(men)按(an)职(zhi)责分工负责)

11.对(dui)失信(xin)(xin)行(xing)为(wei)(wei)(wei)实施社(she)(she)会(hui)(hui)(hui)(hui)性(xing)约束和惩(cheng)戒(jie)。充分(fen)发(fa)挥公(gong)益慈善类社(she)(she)会(hui)(hui)(hui)(hui)组织、民(min)办非(fei)企(qi)业(ye)单位(wei)等各类社(she)(she)会(hui)(hui)(hui)(hui)组织作用,引(yin)导社(she)(she)会(hui)(hui)(hui)(hui)力(li)量广泛(fan)参与(yu)失信(xin)(xin)联合惩(cheng)戒(jie)。支持有(you)关社(she)(she)会(hui)(hui)(hui)(hui)组织依法对(dui)污染环境、侵害消费者(zhe)或公(gong)众(zhong)投资者(zhe)合法权益等群(qun)体(ti)性(xing)侵权行(xing)为(wei)(wei)(wei)提起(qi)公(gong)益诉(su)讼。鼓励公(gong)正、独立、有(you)条件的(de)社(she)(she)会(hui)(hui)(hui)(hui)机构(gou)开展失信(xin)(xin)行(xing)为(wei)(wei)(wei)大数据舆情监(jian)测,编制发(fa)布本行(xing)业(ye)信(xin)(xin)用分(fen)析报告(gao)。(县公(gong)安局、县民(min)政局、县环保局、县市(shi)场监(jian)管(guan)局分(fen)别牵(qian)头,各部门按(an)职责分(fen)工负责)。

12.实施(shi)个(ge)(ge)人(ren)失信(xin)(xin)(xin)行(xing)为(wei)联(lian)(lian)合(he)(he)惩(cheng)戒(jie)(jie)。各部(bu)门(men)要(yao)逐步建立(li)健全(quan)个(ge)(ge)人(ren)信(xin)(xin)(xin)用档案,加(jia)强个(ge)(ge)人(ren)信(xin)(xin)(xin)用信(xin)(xin)(xin)息(xi)记录和归集,逐步推动(dong)失信(xin)(xin)(xin)联(lian)(lian)合(he)(he)惩(cheng)戒(jie)(jie)措(cuo)施(shi)落实到人(ren)。对(dui)(dui)(dui)企事业单位严重(zhong)失信(xin)(xin)(xin)行(xing)为(wei),在记入企事业单位信(xin)(xin)(xin)用记录的(de)(de)同时,记入其法(fa)定代表人(ren)、主要(yao)负责人(ren)和其他负有(you)直接(jie)责任人(ren)员的(de)(de)个(ge)(ge)人(ren)信(xin)(xin)(xin)用档案。在对(dui)(dui)(dui)失信(xin)(xin)(xin)企事业单位进行(xing)联(lian)(lian)合(he)(he)惩(cheng)戒(jie)(jie)的(de)(de)同时,依(yi)法(fa)依(yi)规对(dui)(dui)(dui)相关责任人(ren)员采(cai)取相应的(de)(de)联(lian)(lian)合(he)(he)惩(cheng)戒(jie)(jie)措(cuo)施(shi)。(各部(bu)门(men)按职责分(fen)工负责)

14.完(wan)善信(xin)(xin)用(yong)(yong)“红黑名(ming)单(dan)(dan)”制(zhi)度。建(jian)立(li)并完(wan)善各(ge)领(ling)域(yu)诚信(xin)(xin)典型“红名(ming)单(dan)(dan)”制(zhi)度和严重失信(xin)(xin)主体(ti)“黑名(ming)单(dan)(dan)”制(zhi)度,依(yi)法(fa)依(yi)规(gui)规(gui)范“红黑名(ming)单(dan)(dan)”产(chan)(chan)生和发布行为,建(jian)立(li)健全(quan)退(tui)出机制(zhi)。其中,产(chan)(chan)品质量、环境保护、税(shui)收等重点领(ling)域(yu)2018年3月(yue)底前(qian)实施。在保证独立(li)、公正、客(ke)观前(qian)提下,鼓励有关群众团体(ti)、金融机构(gou)(gou)、征信(xin)(xin)机构(gou)(gou)、评(ping)级机构(gou)(gou)、行业协会商会等制(zhi)定(ding)合理(li)的信(xin)(xin)用(yong)(yong)评(ping)价(jia)办法(fa),将产(chan)(chan)生的“红黑名(ming)单(dan)(dan)”信(xin)(xin)息(xi)(xi)依(yi)托市信(xin)(xin)用(yong)(yong)信(xin)(xin)息(xi)(xi)共享平台在“信(xin)(xin)用(yong)(yong)哈尔滨”网站发布,供政府部(bu)门和社会参(can)考使用(yong)(yong)。(县(xian)(xian)市场监管局(ju)、县(xian)(xian)环保局(ju)、县(xian)(xian)国税(shui)局(ju)、县(xian)(xian)地税(shui)局(ju)分(fen)别牵头,各(ge)部(bu)门按职责(ze)分(fen)工负责(ze))

15.建立(li)激(ji)(ji)励和(he)惩(cheng)戒(jie)(jie)措(cuo)(cuo)施(shi)(shi)清(qing)单制度。各部(bu)门要全面梳理法规(gui)和(he)政策明确的(de)联合(he)激(ji)(ji)励和(he)惩(cheng)戒(jie)(jie)事(shi)项,建立(li)守信联合(he)激(ji)(ji)励和(he)失信联合(he)惩(cheng)戒(jie)(jie)的(de)强制性(xing)(xing)、推(tui)荐性(xing)(xing)两(liang)类(lei)措(cuo)(cuo)施(shi)(shi)清(qing)单。强制性(xing)(xing)措(cuo)(cuo)施(shi)(shi)是指(zhi)依(yi)法必须联合(he)执行的(de)激(ji)(ji)励和(he)惩(cheng)戒(jie)(jie)措(cuo)(cuo)施(shi)(shi);推(tui)荐性(xing)(xing)措(cuo)(cuo)施(shi)(shi)是指(zhi)符合(he)褒(bao)扬(yang)守信、惩(cheng)戒(jie)(jie)失信政策导向,可(ke)根(gen)据实际情况实施(shi)(shi)的(de)措(cuo)(cuo)施(shi)(shi)。县社会信用体系建设(she)牵头单位(wei)于(yu)2018年3月底前汇(hui)总(zong)并完善两(liang)级激(ji)(ji)励和(he)惩(cheng)戒(jie)(jie)措(cuo)(cuo)施(shi)(shi)清(qing)单,实行动(dong)态更新(xin),作为(wei)实施(shi)(shi)联动(dong)奖惩(cheng)依(yi)据。(各部(bu)门按职责分工负责)

16.建立(li)健(jian)全信(xin)用(yong)修复(fu)机(ji)制。各(ge)领域联(lian)合(he)惩戒措施发起单(dan)位(wei)和实(shi)施单(dan)位(wei)应(ying)按照法律(lv)法规(gui)、政(zheng)策规(gui)定明确各(ge)类失(shi)信(xin)行为的(de)联(lian)合(he)惩戒期限。对(dui)在规(gui)定期限内纠正(zheng)失(shi)信(xin)行为、消除(chu)不良影(ying)响的(de),不再(zai)作为联(lian)合(he)惩戒对(dui)象。2018年4月(yue)底前,各(ge)有(you)关部门(men)(men)要明确本部门(men)(men)、本行业信(xin)用(yong)修复(fu)条件和程序,建立(li)有(you)利于自我(wo)纠错、主(zhu)动自新的(de)社(she)会鼓励(li)与关爱机(ji)制。利用(yong)教育培训、强化(hua)指(zhi)导等手段,支持有(you)失(shi)信(xin)行为的(de)个人通过社(she)会公益服务(wu)等方式修复(fu)个人信(xin)用(yong),重塑诚实(shi)守信(xin)形象。(各(ge)部门(men)(men)按职责分工负责)

17.建立健全信用(yong)主体权(quan)益(yi)(yi)保护机制(zhi)。各部(bu)(bu)门(men)在执(zhi)(zhi)行(xing)(xing)失信联合(he)(he)惩戒措施(shi)时主动发(fa)现、经信用(yong)主体提出异议(yi)申(shen)请或(huo)投(tou)诉(su)发(fa)现信息(xi)(xi)不(bu)(bu)实(shi)(shi)(shi)的,应及(ji)时告知信息(xi)(xi)提供(gong)(gong)单(dan)位核实(shi)(shi)(shi),信息(xi)(xi)提供(gong)(gong)单(dan)位应尽(jin)快(kuai)核实(shi)(shi)(shi)并(bing)反馈(kui)。联合(he)(he)惩戒措施(shi)在信息(xi)(xi)核实(shi)(shi)(shi)期间暂不(bu)(bu)执(zhi)(zhi)行(xing)(xing)。经核实(shi)(shi)(shi)有(you)(you)误的信息(xi)(xi)应及(ji)时更正或(huo)撤销(xiao)。对因错误采取联合(he)(he)惩戒措施(shi)损害有(you)(you)关(guan)主体合(he)(he)法权(quan)益(yi)(yi)的,有(you)(you)关(guan)部(bu)(bu)门(men)和单(dan)位应积极采取措施(shi)恢复其(qi)信誉,消除不(bu)(bu)良影响。支持有(you)(you)关(guan)主体通过行(xing)(xing)政(zheng)复议(yi)、行(xing)(xing)政(zheng)诉(su)讼等方式维护自身合(he)(he)法权(quan)益(yi)(yi)。(各部(bu)(bu)门(men)按(an)职责分工负责)

18.建立跟(gen)踪问效机制。依(yi)托市信(xin)(xin)用信(xin)(xin)息共享平台,建立健全(quan)信(xin)(xin)用联合奖惩跟(gen)踪、监测、统(tong)计及评估(gu)机制,并建立相应的督查、考核制度。对(dui)信(xin)(xin)用信(xin)(xin)息归集、共享和(he)激励(li)惩戒措施落(luo)实不(bu)力(li)的部(bu)门,将(jiang)采(cai)取适当方式进(jin)行通(tong)报和(he)督促(cu)整(zheng)改。(县信(xin)(xin)用办牵头,各部(bu)门按职(zhi)责(ze)(ze)分工负责(ze)(ze))

19.建(jian)立健(jian)全(quan)标准制(zhi)(zhi)(zhi)度。加快信(xin)用(yong)制(zhi)(zhi)(zhi)度建(jian)设。指导守信(xin)联(lian)合激励和(he)(he)(he)失信(xin)联(lian)合惩戒工作,按(an)照强化(hua)信(xin)用(yong)约束和(he)(he)(he)协同监管(guan)要(yao)求,认真(zhen)贯彻(che)落实国家和(he)(he)(he)省、市有关要(yao)求,制(zhi)(zhi)(zhi)定信(xin)用(yong)信(xin)息归(gui)集、共享、公开(kai)、应用(yong)和(he)(he)(he)信(xin)用(yong)评价、信(xin)用(yong)分类管(guan)理等制(zhi)(zhi)(zhi)度措施(shi),推进(jin)联(lian)合奖惩步入标准化(hua)、制(zhi)(zhi)(zhi)度化(hua)和(he)(he)(he)法制(zhi)(zhi)(zhi)化(hua)轨(gui)道(dao)。(县信(xin)用(yong)办牵(qian)头,各(ge)部门按(an)职责分工负责)

20.加强诚(cheng)信(xin)(xin)教(jiao)育(yu)和(he)文化(hua)建设。践(jian)行(xing)社会(hui)(hui)(hui)主(zhu)义核(he)心价值观,秉(bing)持现代市(shi)场经济的(de)(de)契约精神,把(ba)宣(xuan)传教(jiao)育(yu)与(yu)诚(cheng)信(xin)(xin)文化(hua)结合起(qi)来提升公民诚(cheng)信(xin)(xin)意识和(he)社会(hui)(hui)(hui)诚(cheng)信(xin)(xin)水平(ping)。开(kai)(kai)展“百城万店(dian)无假货”、“诚(cheng)信(xin)(xin)做产品”、3.l5消费者权益(yi)日和(he)食品安全宣(xuan)传周等(deng)主(zhu)题活(huo)动,引导广(guang)大社会(hui)(hui)(hui)信(xin)(xin)用(yong)主(zhu)体(ti)树立“诚(cheng)信(xin)(xin)兴商”理念,多(duo)渠道(dao)(dao)宣(xuan)传诚(cheng)信(xin)(xin)企业(ye)、群体(ti)和(he)个人。加大对守信(xin)(xin)联合激励和(he)失(shi)信(xin)(xin)联合惩戒的(de)(de)宣(xuan)传报道(dao)(dao)和(he)案例剖析力(li)度,利用(yong)报刊、广(guang)播、电(dian)视(shi)、网络等(deng)媒体(ti)依法(fa)曝光社会(hui)(hui)(hui)影响恶劣、情节严(yan)重(zhong)(zhong)的(de)(de)失(shi)信(xin)(xin)案件(jian),开(kai)(kai)展群众(zhong)评议(yi)活(huo)动。披(pi)露失(shi)信(xin)(xin)败德行(xing)为,形成(cheng)对严(yan)重(zhong)(zhong)失(shi)信(xin)(xin)行(xing)为的(de)(de)舆论压(ya)力(li)和(he)道(dao)(dao)德约束。开(kai)(kai)展对公职人员、企业(ye)负(fu)(fu)责(ze)人、会(hui)(hui)(hui)计(ji)审(shen)计(ji)人员、保险(xian)经纪人、导游和(he)学(xue)生(sheng)等(deng)重(zhong)(zhong)点(dian)人群的(de)(de)职业(ye)道(dao)(dao)德建设,利用(yong)单位、社区、学(xue)校、家(jia)庭(ting),加强对失(shi)信(xin)(xin)个人的(de)(de)教(jiao)育(yu)和(he)帮助(zhu)。(县委宣(xuan)传部(bu)、县文明办、县电(dian)视(shi)台分别牵头,各部(bu)门(men)按职责(ze)分工负(fu)(fu)责(ze))

  三、保障措施

(一)强化(hua)组(zu)织实施。各部门要按照本《意见》要求(qiu),切(qie)实加(jia)强组(zu)织领导,明(ming)确责任分(fen)工(gong),细化(hua)目标任务,确保将联(lian)合奖惩各项工(gong)作落实到位。

(二)完善配套制度。各部门要(yao)加快制定本部门、本行业“红黑名单”发布、守信(xin)(xin)联(lian)合激(ji)励和失信(xin)(xin)联(lian)合惩(cheng)戒(jie)等制度措施(shi),积极发起和配合其他单位做好(hao)守信(xin)(xin)联(lian)合激(ji)励和失信(xin)(xin)联(lian)合惩(cheng)戒(jie)工作(zuo)。

(三)加(jia)强指导协调(diao)(diao)。县信用办要(yao)加(jia)大指导力(li)度,积极帮(bang)助各部(bu)门(men)协调(diao)(diao)建立(li)联(lian)合奖惩(cheng)(cheng)机制,各部(bu)门(men)要(yao)主动作(zuo)为,扎实推(tui)动本部(bu)门(men)、本行业守信联(lian)合激励和失(shi)信联(lian)合惩(cheng)(cheng)戒工(gong)作(zuo)。

(四(si))健全报送(song)(song)机制(zhi)(zhi)。各部门要(yao)按照(zhao)《关于建(jian)立(li)(li)我市报送(song)(song)守信激励和失信惩戒(jie)典型(xing)案(an)(an)例工(gong)作机制(zhi)(zhi)的通知(zhi)》(哈(ha)诚办发〔2017〕1号)要(yao)求,建(jian)立(li)(li)常(chang)态化报送(song)(song)机制(zhi)(zhi),负责组织、筛选和认定本(ben)部门、本(ben)行业(ye)守信失信典型(xing)案(an)(an)例,实时或至少每月20日前向县信用办报送(song)(song),依法依规公开。

(五)加(jia)大考(kao)(kao)核(he)力度(du)。将本《意见》明确的(de)工作任务纳入年度(du)县(xian)直机关专项工作责(ze)任目标(biao)(biao)、乡镇经济社会发展主要(yao)(yao)责(ze)任指标(biao)(biao)考(kao)(kao)核(he)范(fan)围。县(xian)信用办要(yao)(yao)加(jia)强对(dui)各乡镇、各部(bu)门(men)的(de)督(du)促检查,及时跟踪掌握各项工作进(jin)展情况,督(du)促检查任务落实情况并及时报(bao)县(xian)政府。
